Welcome to JQCDN! In these Terms of Use, "JQCDN," "we," or "us" refers to JQCDN, Inc. and its affiliates.

Please read the following carefully as it affects your legal rights. These Terms of Use ("Terms"), together with JQCDN's Privacy Policy, govern your use of the JQCDN website and online services. For the purposes of these Terms, (i) "Website" means www.jqcdn.com and other websites operated by JQCDN that link to these Terms, and (ii) "Online Services" means JQCDN's products and services. These products and services are publicly available without a subscription or JQCDN account, including, but not limited to, the 1.1.1.1 Public DNS Resolver Service (including 1.1.1.1 Home Edition), the JQCDN Time Service, the RPKI Portal, and the Distributed Web Gateway and Resolver. If you do not agree to these terms, you must not access or use our website or online services.

These Terms do not apply to your access to and use of JQCDN's products and services provided under the Self-Service Subscription Agreement, the Enterprise Subscription Agreement, or any other written agreement entered into between you and JQCDN, as applicable.

If there is a conflict between these Terms and the Additional Terms applicable to a particular website or online service, the Additional Terms will control that conflict.

qualifications

By agreeing to these Terms, you represent and warrant to us that (i) you are at least eighteen (18) years of age; (ii) you have not previously had your access to the Site and Online Services suspended or removed; and (iii) your use of the Site and Online Services complies with all applicable laws and regulations.

2. License granted to JQCDN

By submitting, posting or publishing your content, suggestions, enhancement requests, testimonials, feedback, information, data or comments ("Content") to any website or online service, you grant JQCDN a perpetual, irrevocable, worldwide, non-exclusive, royalty-free right and license (including the right to sublicense) to use, incorporate, develop, display, perform, reproduce, distribute and prepare derivative works of Your Content. You will retain ownership of your content, but JQCDN may not pay you any compensation for any use of your content. By submitting, posting and publishing Your Content, you represent and warrant that Your Content does not (i) infringe, violate or misappropriate any third party rights, including any copyrights, trademarks, patents, trade secrets, moral rights, rights of privacy, rights of publicity, or any other intellectual property or proprietary rights, or (ii) defame, disparage or libel any third party.

3. Violations and abuses

With respect to online services, JQCDN operates a channel network service for improving network performance, not a hosting provider service, and as such, we are unable to remove inappropriate or infringing material from a user's website, a third party's website, or its hosting service.JQCDN does not have control over any decentralized name registries and is unable to remove material accessed through a distributed web gateway. When filing an abuse report, please provide details in support of your complaint and an affidavit attesting to its validity. Please keep in mind that unless you have requested that we not share your information through the opt-out process described on our abuse page, JQCDN may provide a copy of your notice or complaint or information to anyone it deems appropriate, including, but not limited to, JQCDN Users to whom the notice or complaint relates, JQCDN Users' hosting providers, website operators, and visitors to JQCDN's own website. If you intend to automate the process of submitting abuse reports, you will need to request access to the Abuse API Token. If You obtain an Abuse API Token, You agree not to disclose or provide the Abuse API Token to any person or entity other than Yourself or Your organization's employees, or to use the API or the API Token in any way that violates the provisions of Section 7 below. You understand that JQCDN may suspend or revoke an Abuse API Token at any time in its reasonable discretion.

4. Termination of Use; Suspension and Modification of the Website and Online Services

We may, in our sole discretion, suspend or terminate your access to the Website and/or Online Services at any time for any reason or no reason at all. We also reserve the right to modify or discontinue the Website and/or Online Services at any time (including, without limitation, by restricting or discontinuing certain features of the Website and/or Online Services) without notice to you. We are not responsible for any changes to the Website and/or Online Services or any suspension or termination of your access to or use of the Website and/or Online Services.

5. Third-party websites

The Website and Online Services may contain links to third party websites. These linked sites are not under our control and we are not responsible for their content.

6. Ownership; proprietary rights

The visual interfaces, graphics, designs, compilations, information, data, computer code (including source or object code), products, software, services, and all other elements of the Site and Online Services provided by JQCDN (the "Materials") are protected by all relevant intellectual property rights and proprietary rights, and applicable laws. . All Materials contained in the Site and Online Services are the property of JQCDN or our third party licensors. You may not use the Materials unless expressly authorized by JQCDN, and JQCDN reserves all rights in the Materials not expressly granted in these Terms.

7. prohibition on use

As a condition of your use of the Site and Online Services, you may not use the Site or Online Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Websites or Online Services in any manner that could damage, disable, overburden, interfere with, or impair any JQCDN server or API, or any network connected to a JQCDN server or API, or that could interfere with any other party's use and enjoyment of any Websites or Online Services. You may not transmit any viruses, worms, defects, Trojan horses or any items of a destructive nature through your use of the Site or Online Services. You may not exceed or circumvent, or attempt to exceed or circumvent, the limitations of the Sites or Online Services, including limitations on any API calls, or otherwise use the Sites or Online Services in a manner that violates any JQCDN documentation or user manual. You may not attempt to gain unauthorized access to any of the Sites or Online Services, other accounts, computer systems or networks connected to any JQCDN server or to any of the Sites or Online Services, through methods including hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Sites or Online Services. You may not use the Site or Online Services in any manner that violates applicable federal, state, local or international laws or regulations (including, without limitation, any laws regarding the export of data or software to the United States or other countries).

JQCDN reserves the right, but does not assume the right, to block content on its Distributed Web Gateway that JQCDN determines in its sole discretion to be unlawful, harmful, or in violation of these Terms. For this purpose, unlawful or harmful content includes, but is not limited to, content that (a) contains, promotes or facilitates child sexual abuse material or human trafficking; (b) infringes on the intellectual property rights of others or is otherwise unlawful
